These Terms of Use govern access to and use of the Echelon Direct public website. Product applications, merchant services, equipment, processing, banking relationships, integrations, private-pilot access, and support may be governed by separate applications, agreements, disclosures, and provider terms.
1. Acceptance of the Terms
By accessing or using this website, you agree to these Terms of Use. If you do not agree, do not use the website. If you use the website for a business or organization, you represent that you have authority to act for it.
2. Website Purpose
This website provides information about Echelon Direct, merchant services, payment technology, equipment, business reviews, sales opportunities, and AutoPilot powered by Echelon ID. It also provides ways to contact Echelon Direct.
3. Informational Nature of Website Content
Website content is general information. It is not legal, tax, accounting, financial, or compliance advice; it is not a binding offer; and it does not replace the terms of an approved application, proposal, schedule, provider agreement, or service contract.
4. Merchant-Services Availability
Products, pricing structures, equipment, processing arrangements, features, integrations, and service availability can vary by business, industry, location, risk profile, provider, compatibility, and applicable requirements. Website descriptions do not create an obligation to provide a particular product or configuration.
5. Applications, Underwriting, and Provider Approval
Merchant services may require a completed application, accurate business and ownership information, identity verification, underwriting, processor or bank approval, equipment and integration review, and acceptance of separate contracts. Echelon Direct does not control every third-party review, approval, settlement, or service decision.
6. No Guaranteed Business Outcome
Echelon Direct does not guarantee approval, pricing, savings, compatibility, uptime, revenue, recovered revenue, appointments, response rates, retention, performance, or any other business outcome. Illustrations, examples, projections, and dashboard values are not promises of future results.
7. AutoPilot
AutoPilot powered by Echelon ID is an Echelon Direct system offered through limited private-pilot availability. Actual use depends on approved access, available integrations, data quality, permissions, merchant controls, provider capabilities, and applicable law.
8. Public AutoPilot Demonstration
The AutoPilot experience on this website is browser-only and illustrative. Dashboard figures, customer records, conversations, appointments, recommendations, alerts, and outcomes shown in the demonstration are sample data used to explain the intended workflow.
9. Demonstration Boundaries
The public demonstration does not send customer communications, move money, create live leads, change merchant systems, access a merchant’s customer records, book real appointments, or perform actions outside the visitor’s browser. Clicking an approval or simulation control changes only the local demonstration state.
10. Private-Pilot and Limited Availability
Private-pilot participation is selective and may require technical, operational, compliance, data, and commercial review. Features and availability can change as connected providers, permissions, integrations, and merchant requirements change.
11. Intellectual Property
The website and its text, design, branding, graphics, software, interfaces, demonstrations, and other content are owned by or licensed to Echelon Direct and are protected by applicable intellectual-property laws. No ownership right is transferred by access to the website.
12. Permitted Use
You may use the website for lawful business evaluation, learning about Echelon Direct, and contacting us about a legitimate inquiry. Any other use requires prior written permission when the law permits us to require it.
13. Prohibited Conduct
You may not:
- use the website for unlawful, fraudulent, or abusive activity;
- interfere with security, availability, or normal operation;
- attempt unauthorized access to systems, data, or accounts;

16. Disclaimers
To the maximum extent permitted by law, the website and public demonstration are provided on an “as is” and “as available” basis. Echelon Direct disclaims warranties that the website will be uninterrupted, error-free, secure, compatible with every device, or suitable for a particular purpose. Some jurisdictions do not allow certain warranty limitations, so a limitation may not apply to you.
17. Limitation of Liability
To the maximum extent permitted by law, Echelon Direct and its officers, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity arising from use of or inability to use the public website. Rights that cannot lawfully be limited remain unaffected.
18. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Echelon Direct and its officers and personnel from third-party claims, losses, and reasonable costs arising from your unlawful use of the website, your violation of these Terms, or information you submit without authority. This obligation does not apply where prohibited by law.

We may restrict or end access to the website when reasonably necessary to protect the website, users, Echelon Direct, or third parties; respond to misuse or security concerns; comply with law; or maintain operations.
